Patio Experience, LLC, a Delaware limited liability company doing business as The Patio Experience ("The Patio Experience," "we," "our," or "us"), respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect personal information when you interact with us through www.thepatioexperience.com, any subdomain, any mobile application, any offline interactions (including phone calls and in-person events), and any other feature or service that links to or references this Privacy Policy (together, the "Services").

We may combine data we collect through the Services. Except as otherwise required by applicable law, this Privacy Policy applies to all of that data.

1. Personal, Sensitive, and Non-Personal Information We Collect and How We Use and Disclose It

We refer to data that is linked to a specific identifiable individual as "personal data" or "personal information." We treat other information, such as IP addresses and cookie identifiers, as personal data where required by applicable law. We treat certain personal information as "sensitive data" where required by applicable law.

The table below summarizes the categories of personal information we collect, why we use it, and with whom we share it. Additional detail appears in Section 2.

Sources. The personal information above is collected from you directly (for example, when you place an order, create an account, book a consultation, or call or email us), from third parties (such as marketing partners, data providers that supplement information about you, public sources, and social media platforms you use to interact with us), and automatically through cookies, pixels, scripts, and mobile identifiers as described in Section 2.

Purposes explained. We use your personal information to: provide services and fulfill orders; communicate with you about orders, support, and marketing; personalize your experience and serve relevant advertising; run our business, including analytics, reporting, fraud prevention, and security; comply with legal obligations; and protect our rights, your rights, and the rights of others. We will not use your information for materially different purposes without either providing notice or obtaining consent as required by applicable law.

Automated Analytics and Machine Learning. We may use automated systems and machine-learning models, including artificial intelligence tools provided by third-party vendors under written service-provider agreements, to analyze patterns in personal information and aggregated data for internal business purposes such as forecasting sales, margin, and inventory; identifying trends in customer behavior; planning marketing; and improving the Services. Outputs of these analyses are used to inform decisions made by members of our team. We do not use these tools to make automated decisions that produce legal or similarly significant effects on individual consumers, including decisions about pricing, credit, denial of service, or eligibility, without human review. Where we use a third-party AI or analytics vendor, we contract with that vendor as a service provider, and we do not authorize the vendor to use your personal information to train its general models or for any purpose other than providing services to The Patio Experience.

2. Additional Details About Our Data Practices

2.1 Information We Receive or Collect from Third Parties

We may receive information about you from: business partners who help us deliver products and services; data providers who enrich contact and demographic data we hold; public sources; and social media platforms and other third-party services you use to interact with us.

2.2 Data Collected Automatically

We and our service providers use cookies, pixel tags, embedded scripts, mobile advertising identifiers (such as IDFA on Apple devices and Advertising ID on Android devices), and similar technologies to operate and improve the Services, measure and manage advertising, remember your preferences, and keep the Services secure.

2.3 Live Chat

If you use our live chat feature, we may record, use, and retain the information you provide and the content of the conversation to assist you, provide support, train our team, and improve our Services. If you do not consent, please do not use the chat feature.

2.4 Phone Calls

The Patio Experience does not currently record phone calls. If we begin recording calls in the future, calls with our sales and support teams may be monitored and recorded for training, quality assurance, and security. Where required by applicable law, we will provide a notice at the start of the call and you may decline recording by ending the call or asking that the call continue without recording. By remaining on the line after any such notice, you would consent to the recording.

2.5 Photos and Videos

If you submit photos or videos, we may display them on the Services and in marketing materials. We do not create records of facial geometry from your photos or videos, we do not use them for facial recognition, facial surveillance, or other biometric identification, and we do not use vendors that perform biometric processing on photos or videos you submit.

2.6 Disclosure to Third Parties

We may disclose personal information to the categories of recipients identified in Section 1, including: advertising and analytics partners; affiliates; third-party business partners; social media and other third-party platforms; sweepstakes and contest partners; order-fulfillment service providers, including payment processors, fulfillment centers, shipping carriers, and delivery and installation partners; technology service providers; communications service providers; customer-service providers; law enforcement and government agencies where required by law; successors in connection with a business transition such as a merger, acquisition, financing, or sale of assets; third parties to whom you direct us to share your information; and other service providers acting on our behalf.

3. Third-Party Advertising and Analytics; Privacy Controls; Do-Not-Track

We work with third-party advertising partners and analytics providers (for example, Google, Meta, and our email marketing platform) to serve ads and measure performance. These partners may set and access their own cookies, pixels, and other identifiers on your device. We may share information, typically aggregated, de-identified, or Device ID/Interaction Information and non-precise location, with these partners for measurement and for targeting ads on and off the Services.

3.1 Your Cookie Choices

You can control cookies and similar technologies through your browser settings (most browsers let you block, delete, or limit cookies). You may also use industry opt-outs at the Network Advertising Initiative (networkadvertising.org) and the Digital Advertising Alliance (aboutads.info/choices). To stop receiving marketing emails from us, use the unsubscribe link in any marketing email or contact legal@thepatioexperience.com.

3.2 Global Privacy Control (GPC)

Global Privacy Control is a browser-level signal that automatically communicates your privacy preferences to websites. When we receive a GPC signal from your browser, we treat it as a valid request to opt out of the sale of your personal data and to opt out of targeted advertising, to the extent those rights are available to you under applicable law. 3.3 Do-Not-Track

Our Services do not respond to "do not track" browser signals. We recognize Global Privacy Control signals as described above.

4. Your Choices

4.1 Email

You may unsubscribe from marketing emails by clicking the unsubscribe link in any marketing email, by updating your preferences in your account, or by contacting us at legal@thepatioexperience.com. Transactional emails, such as order confirmations and shipping notices, may continue to the extent required to fulfill your order.

4.2 Text Messages

If you provide a phone number with your order, we may send transactional SMS or MMS messages relating to your order, including order confirmations, shipping notifications, and delivery updates. Standard carrier message and data rates may apply. Reply STOP to any message to opt out of further transactional messages; opting out may delay or prevent service notifications about your order.

The Patio Experience does not currently send marketing or promotional SMS or MMS. If we begin sending marketing messages in the future, we will obtain your prior express written consent before doing so.

4.3 Direct Mail

To opt out of postal mail marketing, contact legal@thepatioexperience.com with your name and mailing address.

5. Security

We take commercially reasonable steps designed to protect personal information. No method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

6. Third-Party Content and Links

The Services may contain links to third-party websites, content, or services that we do not control. This Privacy Policy does not apply to those third parties. We encourage you to review their privacy policies and terms.

7. Data Retention

We retain personal information only for as long as necessary to provide the Services, fulfill the purposes described in this Privacy Policy, comply with legal obligations, resolve disputes, and enforce our agreements. The default retention periods are:

        Order and transactional records - retained for seven (7) years to satisfy tax, warranty, product liability, and consumer-protection requirements.

        Account and contact information - retained for the active life of the account plus two (2) years after the last interaction, unless a longer period is required by law.

        Marketing preferences and unsubscribes - retained indefinitely for suppression-list purposes.

        Chat transcripts - retained for up to twenty-four (24) months, then deleted or anonymized.

        Device ID and cookie data - retained for up to twenty-four (24) months or as set by the cookie's own lifespan, whichever is shorter.

        Legal hold - information subject to a legal hold, investigation, or dispute is retained until the matter is resolved.

8. Breach Notification

If we discover a security incident that involves unauthorized access to, acquisition of, or disclosure of your personal information, we will investigate, take reasonable steps to contain and remediate the incident, and notify you and applicable regulators as required by law. Where we provide notice to you, we will do so by email to the address you have provided, or by postal mail if we do not have a valid email address, within the time frame required by applicable law, and in any event not later than sixty (60) days after discovery unless a shorter period is required.

9. Consent to Transfer

The Patio Experience is based in the United States and operates only within the United States. By using the Services, you consent to the transfer, processing, use, sharing, and storage of your personal information in the United States.

10. General Audience Site

The Services are not directed to children under the age of thirteen (13), and we do not knowingly collect personal information from children under thirteen. If we learn that we have collected personal information from a child under thirteen, we will delete that information promptly. If you believe a child has provided personal information to us, contact legal@thepatioexperience.com. The Services are not intended for individuals under eighteen (18).

11. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will update the effective date and post a prominent notice on the Services. We may also notify you by email to the address on file or by other means. Your continued use of the Services after the effective date of the updated Privacy Policy constitutes your consent to the changes to the fullest extent permitted by applicable law.

13. Jurisdiction-Specific Rights

13.1 Colorado, Connecticut, Delaware, Iowa, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, and Virginia

If you are a resident of one of these states, you may have the following rights under your state's privacy law:

        Right to know / right to access - request confirmation of whether we process your personal data and a copy of the personal data we process about you.

        Right to delete - request that we delete personal data we have collected from you.

        Right to correct - request that we correct inaccuracies in your personal data (not available in Iowa or Utah).

        Right to portability - request a copy of your personal data in a readily usable format.

        Right to opt out of sale or targeted advertising - request that we stop selling your personal data or using it for targeted advertising. Because we do not sell personal data to third parties for monetary compensation, some state-law definitions of "sale" may not apply; however, our sharing of certain Device ID/Interaction Information with advertising partners may meet other state-law definitions, so we honor this opt-out in every state that recognizes it.

        Right to appeal - if we decline a rights request, you may appeal by contacting us at legal@thepatioexperience.com with "Appeal" in the subject line.

To exercise these rights, contact legal@thepatioexperience.com. We will respond within the period required by your state's law (generally 30 to 45 days). We may need to verify your identity before fulfilling a request. Authorized agents may submit requests on your behalf in states that recognize agent submissions; we may require documentation to verify authorization and the consumer's identity.

        Sensitive Data - in states that require consent to process sensitive data (including Colorado, Connecticut, Delaware, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, and Virginia), we will obtain your consent before processing any sensitive data as defined by your state's law. In Iowa, Utah, and other states that provide an opt-out rather than an opt-in for sensitive data, you may opt out using the methods above.

        Profiling - we use automated systems and machine-learning models for internal analytics, forecasting, and trend analysis as described in Section 1. We do not use your personal data for profiling that produces legal or similarly significant effects on you, such as automated decisions about pricing, credit, denial of service, or eligibility, without human review.

13.2 Nevada

If you are a Nevada resident, you may request that we not sell certain personal information that we have collected or will collect about you. We do not sell personal information as defined by Nevada law. 13.3 California

California residents have additional rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act, including the right to know, the right to delete, the right to correct, the right to opt out of sale and sharing, the right to limit use of sensitive personal information, the right to portability, and the right to non-discrimination. California residents who wish to exercise these rights may do so by emailing legal@thepatioexperience.com or calling (833) 837-2846. We will verify your identity using information you provide and information we already hold, and we will respond within 30 days. We do not discriminate against you for exercising these rights.
